LOST OR STOLEN PURSE OR WALLET ... WHAT TO DO!


Unfortunately, the author of this piece who happens to be an attorney has firsthand knowledge, because his wallet was stolen and within a week the thieves ordered an expensive monthly cell phone package, applied for a VISA credit card, had a credit line approved to buy a Gateway computer, received a PIN number from DMV to change my driving record information online, and more.  But here's some critical information to limit the damage in case this happens to you or someone you know.
 
As everyone always advises, cancel your credit cards immediately, but the key is having the toll free numbers and your car numbers handy so you know whom to call. Keep those where you can find them easily. File a police report immediately in the jurisdiction where it was stolen, this proves to credit providers you were diligent, and is a first step toward an investigation (if there ever is one).  
 
But here's what is perhaps most important:

 (I never ever thought to do this) Call the three national credit reporting organizations immediately to place a fraud alert on your name and SS#. 

I had never heard of doing that until advised by a bank that called to tell me an application for credit was made over the Internet in my name.
 
The alert means any company that checks your credit knows your information was stolen and they have to contact you by phone to authorize new credit. By the time I was advised to do this, almost 2 weeks after the theft, all the damage had been done. The names and phone numbers are at the end of this message.
 
There are records of all the credit checks initiated by the thieves' purchases, none of which I knew about before placing the alert.  Since then, no additional damage has been done, and the thieves threw my wallet away this weekend (someone turned it in). It seems to have stopped them in their tracks. Print out these important numbers and keep them handy:

WHY CHECKS, BALANCES AND OVERSIGHT IS SO IMPORTANT ...

A Well-Planned Retirement.....From “The London Times”, May 15, 2009

Outside the Bristol Zoo, in England, there is a parking lot for 150 cars and 8 coaches, or buses.
It was manned by a very pleasant attendant with a ticket machine charging cars 1 pound (about $1.40) and coaches 5 (about $7). This parking attendant worked there solid for all of 25 years.


Then, one day, he just didn't turn up for work.


"Oh well", said Bristol Zoo Management - "we'd better phone up the City Council and get them to send a new parking attendant..."


"Er ... no", said the Council, "that parking lot is your responsibility."


"Er ... no", said Bristol Zoo Management, "the attendant was employed by the City Council, wasn't he?"


"Er ... NO!" insisted the Council.


Sitting in his villa somewhere on the coast of Spain, is a bloke who had been taking the parking lot fees, estimated at 400 pounds (about $560) per day at Bristol Zoo for the last 25 years.


Assuming 7 days a week, this amounts to just over 3.6 million pounds ($7 million)!


And no one ever knew his name.

WHEN DO THE WISHES OF THE VOTERS MEAN NOTHING AT REFERENDUM ...


When John [Spincocchio] Hodge says it doesn't. I'll just convene a 'special interest' Town Meeting and push through a change to the referendum. Let me count the ways ...
Last night, June 18th., John Hodge announced that the 100k bathroom project has been now been replaced by a project which will cost $200k.  This is the same project that the taxpayers voted against last year.  In addition to bathrooms, the new structure includes a storage area, press box, concession area and a ticket area.  It will be located between the two sets of bleachers on the Rebel Turf field.  Approximately $125,000 will be received as a donation.

(Apparently, Mr. Hodge will be holding a Town Meeting next week for the people to vote to accept the donation.)  He asked for an additional $50k from the BOE.  The BOE voted in favor of “designating” money to this project (2 opposed).  [NOTE: APPARENTLY THE BOF WAS CORRECT ... THERE WAS TOO MUCH MONEY IN THE BOE BUDGET!!]  The BOE also voted to return an additional $61,657 to the town (2 opposed).  There are two major issues here: 

  1.  The BOE does not have unilateral authority to appropriate funds to a capital project.  (CGS10-222).

  2. The structure/septic will be located 40-50 feet away from a well with potable water.  Dr. Siebert has confirmed with the State that a septic should be 150 feet away from the well to make sure that the well water is not contaminated.  This is a huge concern given the fact that the water system at the High School/Middle School is failing.  Hodge claims that he also checked with the State and was told that placement of a septic so close to a well would not be a problem. [NOTE: HODGE [SPINCOCCHIO] ALSO SAID HE CHECKED WITH THE STATE ON THE BRIDGE OVER BALL POND BROOK, ONLY TO HAVE TO REMOVE IT ... TAXPAYERS LOST APPROX. $140,000]

The discussion could not be seen on cable TV because the live broadcast was turned off at that time. 


TAKE AWAY:


The special interests will show up and, just like the weevils, they won’t care whether the process was legal or not.  With each project, a new group of people (40-200 usuall) with an interest in the issue, come out to support whatever it takes to get what they want whether it is done right or not. 

As long as people are willing to support this approach what can you do?  I think the BOF has tried to keep process legal, but THEY have been vilified by each successive special interest group… they don’t want to hear why the process is a mess. 



And Yes the BOE was whining again their budget was bare bones as usual this year that they couldn’t afford any further cuts. So now they are buying toilet paper.
How many books can be bought with 50K? or how many rooms could be painted throughout the system in the three buildings for 50K? How about air quality improvements or removal of the smelly and stained carpeting in the classrooms, especially in Consolidated if it hasn’t been already done for health reasons?
What is the town health department opinion about the distance from wells. I always thought a septic couldn’t be any closer than 75 feet to a well and 150 feet from wetlands, but it may have changed.  Maybe like the bridge over Ball Pond Brook ... it doesn't matter until you get caught!

States racing to cobble together new budgets for their July 1 deadline could find themselves sinking back into red ink sooner than they think, as Americans’ income and the taxes they pay on it shrink, new data show.

Personal income taxes paid to the states plummeted 26 percent, or $28.8 billion, in the first four months of 2009, compared with the same time period last year, the Nelson A. Rockefeller Institute of Government said in its June 18 report.


On average, personal income tax represents about one-third of annual state revenues, but makes up well over half of annual revenues in Colorado, Connecticut, Massachusetts, New York, Oregon and Virginia.

LOCAL GOVERNMENT SMALLER, LEANER AND MORE EFFICIENT ...

In the last year, Connecticut has lost more than 65,600 jobs. It is time for state lawmakers to focus on helping businesses create jobs, and on making state and local government smaller, leaner and more efficient.




Any questions? There should be at least one question and a commitment. The commitment is that "I will vote at the next election!", the question, "Why me?" If you ask that question then the answer should be apparent.

IRS Weighs Rules for Taxing Private Use of Work Cellphones

WASHINGTON -- The IRS is weighing a proposal to deem one-quarter of employees' use of work cellphones as personal use and therefore subject to tax as a fringe benefit.

The proposal is one of several options the IRS put forward this week on the tax treatment of employer-provided cellphones. Current law already requires that the value of those cellphone services be included in a worker's gross income, unless the employee keeps detailed records showing that the cellphone is used for work only.

But as a practical matter, many companies don't enforce the record-keeping requirements. The IRS proposals from this week aim to simplify the requirements and aid enforcement of the law.

The IRS notice might re-energize an effort by cellphone companies such as Verizon Communications, Inc. and Sprint Nextel Corp . to repeal the 20-year-old law that classifies work cellphones as a fringe benefit subject to personal income tax.

The IRS in the past couple of years has begun to question employer deductions for cellphone services during tax audits, said Jot Carpenter, vice president of government affairs for CTIA-The Wireless Association, a trade group of cellphone equipment manufacturers and service providers.

Mr. Carpenter has been pressing lawmakers to repeal the requirement, arguing that the current widespread use of cellphones for work wasn't contemplated by the 1989 law, which targeted "CEOs and rich people."

"The idea that you should keep a log saying, 'I made a call saying I will be late for dinner again,' that's a totally cumbersome and burdensome requirement that most employers and employees are not going to comply with," said Mr. Carpenter.

The IRS, in a Monday notice, proposed options intended to simplify the requirement for employers. One proposal is a "safe harbor" that would deem 75% of work cellphone usage to be for work, and 25% to be personal. Under that scenario, employer deductions would be limited accordingly and employees would be taxed on the value of the personal use.

As an alternative approach, employees could satisfy the requirement by showing proof that they maintain a personal cellphone for use during work hours. Or, IRS could set a certain number of minutes that would be considered "minimal personal use" and thus disregarded for tax purposes.

In a third option, employers could use statistical sampling to determine what portion of their workers' use of cellphones is personal and how much work-related.

The IRS will accept comments from the public regarding the proposals until Sept. 4.

The effect on cellphone companies of strict IRS enforcement of the provision could be substantial. For example, companies wishing to avoid problems during audit with IRS could cancel company-wide wireless contracts, and begin reimbursing employees for a portion of their own cell service contracts.

Cellphone companies say that because rates have declined so dramatically in the past decade, and night and weekend calls are free under many plans, it doesn't make sense for the IRS to go after an employee benefit that may amount to nickels and dimes.

After 2012 it doesn't matter, so the IRS should save the money and forgetaboutit!

"This is a regulation from a bygone time, dating back to the infancy of the cellphone business, and it is in desperate need of updating," said Howard Woolley, senior vice president with Verizon Wireless. Mr. Woolley said the IRS proposals this week, while welcome, still might burden small businesses. Verizon will continue to press for repeal of the 1989 law, he said.

The IRS didn't respond by publication time to requests for comment on this story.

Besides wireless companies, a diverse coalition including local government groups, college administrators and farm groups is seeking legislation to remove cellphones from the types of property that are taxable fringe benefits, in the absence of strict record-keeping.

Such legislation sponsored by Reps. Sam Johnson (R., Texas) and Earl Pomeroy (D., N.D) passed the House in 2008 but stalled in the Senate. Those lawmakers and Sens. John Kerry (D., Mass.) and John Ensign (R., Nevada) have introduced similar bills this year.

Some universities, including the University of California system, have wound up owing additional payroll taxes because they couldn't substantiate, on IRS audit, that their employees use of cellphones was for work only.

Mr. Johnson said in a statement to Dow Jones Newswires that the IRS proposals don't simply record-keeping enough. "Instead, the Congress should repeal, once and for all, this outdated and costly record-keeping requirement," he said.

This capability adds a new dimension to the video/communications education programs for the New Fairfield School District. Channel 17 funding should be redirected with a YouTube Channel and associated equipment.  Thereby allowing greater distribution, access and involvement.


A Flip Video at a cost of $160 with shipping puts the camera into more student hands thereby allowing a broader perspective on Channel 17 productions.   The existing equipment could be redeployed into a higher level production.


The new whiteboards proposed would provide a new medium for education and involvement within the student body.

H.R. 2589, The Municipal Bond Insurance Enhancement Act of 2009

H.R. 2589 would establish the Office of Public Finance in the Department of the Treasury to make available Federal reinsurance for insurers of tax-exempt municipal bonds.




MILFOIL WEEVIL REARING ~ YES WE CAN!!!

The native milfoil weevil (Euhrychiopsis lecontei) is a milfoil specialist, and will feed primarily on Eurasian watermilfoil (Myriophyllum spicatum) if it is available.  This characteristic makes it a useful biological control agent for Eurasian watermilfoil, an invasive, non-native aquatic weed.  The Department of Ecology aquatic weed monitoring group collected, raised and released milfoil weevils during 2002 and 2003.  The following method summarizes our experiences raising milfoil weevils in aquariums for subsequent release.

Aquarium Preparation: 
Several types of containers can be used successfully to rear milfoil weevils.  We have used both commercial aquariums designed for fish, and food grade plastic containers that are transparent enough to allow light through the lid and sides.
The aquariums should be thoroughly scrubbed and rinsed before and between uses, using a mild biodegradable soap if needed.  Set the tanks under suspended full-spectrum fluorescent lights (lights specifically designed for plant growth – generally available at aquarium or hardware stores).  Put the lights on a timer to maintain a 16-hour day length.  The optimal water temperature range for the weevils is 24 ± 3°C (75 ± 5.5°F).  If high air temperatures force the water temperature to rise, partial water changes can be used to cool the aquarium water. 

Untreated water should be used to fill the tanks; chlorinated water supplied by most city water systems should not be used.  If untreated water is not available, water treatment products are available from aquarium suppliers to rid the water of chlorine.
Aerators should be inserted into each aquarium and run constantly, bubbling gently through an air-stone or strip.  Ensure that the tanks are completely covered.  Adult weevils have been observed to attempt to escape from the aquariums and will crawl from the corners if the top is left ajar.

Weevil Life Cycle 

The female weevil generally lays her eggs on the growing tips of milfoil stems.  The oval, creamy yellow eggs are laid individually and are about 0.5 mm in length.  After 3-6 days, the larvae emerge from the eggs.  The larvae feed on the milfoil growing tips for 3-5 days after hatching and then move to the stem where they continue to feed.  They are most often found on the upper portions of the plant, and can be seen curling around or tunneling through the stem.  Larvae are typically yellow in color and are elongate with a dark, round head.  Larval development takes 8-15 days.  Older larvae reach a length of about 4.5 mm., at which time they craft a pupal chamber in the thicker portions of the stem below the larval feeding damage.  The pupae develop in their casing for 9-12 days until they emerge as adults.  Adult weevils, usually with lengths of 2-3 mm., can be typically detected on the upper 1 m (3.3 ft.) portion of the plant and have been reported to live as long as 162 days.   The complete life cycle from egg to adult takes 23-27 days at 20-25°C (68-77°F).  Research indicates that weevil productions in the lab seem to be the greatest if the weevils are kept in the aquaria for 7-14 days.  See the milfoil biocontrol website for additional information (http://fwcb.cfans.umn.edu/research/milfoil/milfoilbc.html).
Milfoil Weevil Collection:
In lakes where weevils are present, the adults can be found by snorkeling on the water surface and searching the upper sections of the milfoil beds.  If the day is sunny, they can be spotted by the colorings on their back and belly flashing with their movements.  Occasionally more than one weevil will be found on the same milfoil segment. They cling tightly to the milfoil and should be collected with the milfoil to avoid direct handling.   Pinch the milfoil stem several inches below where the weevil is and gently place it in a sealable one gallon plastic bag.  Several milfoil stems with weevils can be placed in the bag.  Be sure to keep bags sealed, and watch closely as new stems are added as weevils may try to swim out.  Keep the bags cool while transporting them to the aquariums.
Eurasian milfoil will also need to be collected for the weevils to eat in the aquariums (preferably from the lake where the weevils will be placed).  It should not be flowering, have any visible insect injury or other damage and should have full and healthy top ends, free of excess algae.
Establishing Weevils in the Lab:
For the weevil’s food and habitat, gather about 10 milfoil plants in a bundle.  Include a stainless steel bolt or galvanized nail for weight and secure it with a zip-tie.  Place 5 or 6 bunches into each aquarium (as space allows).  Allot approximately one weevil per gallon of water in each tank, and place the weevils as soon as possible after collection.  Avoid handling the weevils directly; rather, place them in the tanks on the milfoil they were collected with.
Precise records of weevil numbers going into the tanks should be kept if they are being reared for research purposes.  If lake groups are simply trying to control their milfoil problem, it is at least recommended to keep track of the approximate weevil numbers to estimate developmental rate and progress.
Throughout the rearing period, supply healthy milfoil plants to the tanks as needed, and ensure that the water levels and temperatures are maintained.  Damage to the milfoil can typically be observed within a few days, evidenced by darkened and tunneled milfoil stems and top ends.
Weevil Release: 
After a rearing period of one to two weeks, the weevils should be sufficient in number for introduction to the augmentation site.  If weevil productivity is to be counted, remove milfoil bunches from the aquariums one at a time and place the bunch in a tray of water until ready for inspection.  Examine each milfoil fragment individually under good lighting, preferably with a dissecting microscope or magnifying glass.  Count and record weevil numbers in each life stage.  After this analysis, gather the milfoil fragments into large zip-lock bags filled with water and keep cool during transport.  Weevil introduction to the test site should occur the same day as their removal from the aquaria if possible.  If this is not possible, the weevils should be kept in well aerated water until they can be transported.
The milfoil fragments with the weevils should be gently intertwined with existing dense milfoil growth near the water surface.  This can be accomplished by snorkeling or from a boat, allowing minimal disturbance to the plants.  The objective is to keep the fragments affixed to the milfoil tops where they have best chance of survival rather than sinking to the lake bottom.  Sometimes it is necessary to tie the milfoil fragments with weevils on to rooted milfoil in the lake.
Keep precise records of the release sites and dates.  This process of rearing and release can be continued throughout the summer, but should be completed by the end of August, as it is believed weevils begin their migration to the shoreline for over-wintering in September.

TO BOND OR NOT TO BOND ... WHERE'S THE LEGAL OPINION?

"Our grant-addicted, free-money, won't cost the taxpayers a thin dime" First Selectman, suddenly deprived of its regular funding fix, was in convulsions when the Board of Finance voted not to appropriate weevil funds for an appropriation voted by a Town Meeting.  For a quick review of the events, just rewind the clock to the Board of Finance meeting after that Town Meeting for the Hart Bus parking lot issue, New Fairfield Dog Park, and lastly the weevil science experimental project.


The fly in the soup is complex but the Board of Finance according to statutes are the only ones that can make appropriations and denied the request; when John Hodge launched his newest funding, high wire act with great fanfare and bravado and a packed [stacked] meeting ... So, in a desperate attempt to circumvent the Board of Finance once again, John Hodge dared go where no other First Selection had gone before. 

Miraculously a petition, out of thin air appeared in John's hands with 300 plus signatures and more to come.  The petition calling for another Town Meeting this time with a different question, certainly more focused on language rather than procedure and policy.  The following question was on that petition: "Shall the town approve the expenditure of $15,000 for the Milfoil Weevil Control Project within the borders of New Fairfield and the issuance of bonds in the amount of $15,000 to meet said expenditures."  
WOW!!!, Another, Invasive Aquatic Plant Program [IAPP] [supported by the federal government]. So now we change the name to a weevil science experiment to supplement the ongoing federally supported Sail Harbor IAPP pilot study in New Fairfield.

Now, expenditures are different than appropriations and bonding is an interesting method of appropriating funds for projects, but experiments or booster shot science, please!  Where are the real scientific results and long-term plans from existing pilots? 

THE RUB: Bonding requires a legal opinion ... John Hodge knowingly called the Town Meeting for June 3rd. without a legal opinion not from Town Counsel but rather from Bond Counsel.

We were unable to find a “New Fairfield” definition/policy but came across the following write up included on page 23 Item G. Capital Assets of the town’s 2007 Audit Report by Blum Shapiro:

“Capital assets, which include property, plant, equipment and infrastructure assets (e.g., roads, bridges, sidewalks and similar items), are reported in the applicable governmental or business-type activities columns in the government-wide financial statements. Capital assets are defined by the government as assets with an initial, individual cost of more than $5,000 and an estimated useful life in excess of one year (the 2008 Audit by McGladrey says $5,000. and TWO  years). Such assets are recorded at historical cost or estimated historical cost if purchased or constructedDonated capital assets are recorded at estimated fair market value at the date of donation. [CAN'T WAIT TO SEE THE NUMBERS!]

The cost of normal maintenance and repairs that do not add to the value of the asset or materially extend asset lives are not capitalized.

Major outlays for capital assets and improvements are capitalized as projects are constructed.
Property, plant and equipment is depreciated using the straight-line method……………” 

SIMPLE EXPLANATION: CAPITAL ASSET VALUE WHERE IS IT?  WHAT IF THE WEEVILS MOVE TO BROOKFIELD, DANBURY, NEW MILFORD OR PERHAPS TO SHERMAN TO VISIT THE OTHER WEEVILS?
